However, the protections put in place to women did not recognise the extent of the work needed to tackle the deep-seated causes of gender inequality. Furthermore, some of the principles enshrined in the Declaration are arguably harmful to women’s cause. For example, Helen Holmes criticises the protection by the UDHR in Article 16 of the family as ‘the natural and fundamental group unit of society’ which is ‘entitled to protection by society and the State.’ She argues that the notion of ‘family’ is a fluid notion, which may encompass varying cultural practices, number of wives, childbearing and childrearing expectations, matrimonial ceremonies and customs, and implications for the freedom or otherwise of women, and its protection acts to entrench institutions inimical to gender equality.The International Covenant on Civil and Political Rights (ICCPR), a vital part of the international rights protection framework set up by the UN which became effective in 1976, is similar to the UDHR in that it also seeks to protect rights ‘without distinction of any kind’ (Article 2) and requires states to ‘ensure the equal right of men and women’ to these protections (Article 3). Requirements of states to ‘ensure the quality of rights and responsibilities of spouses as to marriage, during marriage and at its dissolution’ (Article 23(4)) and to prohibit discrimination (Article 26) are also included in the Covenant, but again there are no requirements for states to be pro-active in tackling issues of gender inequality. Its twin, the International Covenant on Economic, Social and Cultural rights (ICESCR) includes similar provisions.
